Your Security Deposit
When you moved into your apartment, your landlord probably required you to pay a security deposit. Your landlord must return your security deposit to you, less any lawful deduction, at the end of the lease or within a reasonable time after the end of your lease. A landlord can use your security deposit for the following reasons: 1) as reimbursement for the reasonable cost of repairs, beyond normal wear and tear, if the tenant damages the apartment, or 2) as reimbursement for any unpaid rent.
In the City of Syracuse, local law requires a landlord to refund a security deposit within twenty-one days of the end of the lease or to provide an itemized list of damages or back rent owed for which the security deposit is being withheld.
Landlords of buildings with six or more apartments must put your security deposit in an interest-bearing bank account. Tenants must be given the option of having this interest paid to them annually, applied to rent, or paid at the end of the lease term.
Keep as much proof as possible that you have kept your apartment well maintained and that you cleaned it before you moved out. This includes photographs or video of your apartment before and after you lived there, receipts of cleaning supplies you used prior to moving out, a checklist or inspection of damages present in the apartment before and after you lived there (preferably made in writing and with your landlord present). Designate one roommate to save all of this proof until everyone’s security deposit has been returned.
If a problem arises with the return of your security deposit, you should first try to resolve it with your landlord before taking other action. If the dispute cannot be resolved, you may contact Student Legal Services at 443-4532. You may also file a complaint with the New York State Attorney General’s Office. Complaint forms can be found online (under “Consumer Issues”) at http://www.oag.state.ny.us. You can also call the Attorney General’s Consumer Hotline for more information at 1-800-771-7755.
Reminder:
Before you move, be sure to complete a Change of Address form with the United States Post Office. For more information contact the US Post Office at: www.moversguide.com. Also, for international students and scholars, in order to maintain valid immigration status, you must update your address information in MySlice and submit the appropriate online form within 10 days of moving.
